Terms of Service

These Terms of Service are governed by the laws of the Republic of Mauritius and comply with the Information and Communication Technologies Act 2001 and the Data Protection Act 2017.

1. Acceptance of Terms

By accessing or using Space.co.mu ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Service Description

Space.co.mu provides file sharing and storage services with the following features:

  • Anonymous file uploads (7GB daily limit, Mauritius & Seychelles only)
  • Registered user accounts with various storage plans
  • Secure file transfer and sharing capabilities
  • Folder organization and guest access management
  • Download tracking and analytics

3. User Accounts

3.1 Registration

  • You must provide accurate and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must be at least 18 years old to create an account
  • One account per person or entity is allowed

3.2 Account Security

  • You are responsible for all activities under your account
  • Notify us immediately of any unauthorized access
  • We reserve the right to suspend accounts that violate these Terms

4. Service Plans and Limits

4.1 Anonymous Users

  • 7GB daily upload limit
  • 7-day file retention
  • Available only from Mauritius & Seychelles IP addresses
  • Up to 5 files per upload session

4.2 Premium Plans

  • Storage limits as per selected plan (100GB - 10TB)
  • Customizable retention periods
  • Priority support
  • Advanced features (password protection, custom expiry, analytics)

5. Acceptable Use Policy

5.1 Prohibited Content

You may not upload, share, or store:

  • Illegal content or materials that violate any laws
  • Copyrighted material without proper authorization
  • Malware, viruses, or harmful code
  • Adult content or pornography
  • Content that promotes violence, hatred, or discrimination
  • Personal information of others without consent
  • Spam or deceptive content

5.2 Prohibited Activities

  • Attempting to bypass service limitations
  • Using automated scripts without permission
  • Reverse engineering or hacking the Service
  • Reselling or redistributing the Service
  • Using the Service for illegal activities
  • Impersonating others or creating false identities

6. Content Rights and Responsibilities

  • You retain ownership of content you upload
  • You grant us a license to store and serve your content
  • You are responsible for ensuring you have rights to upload content
  • We may scan files for security and compliance
  • We reserve the right to remove violating content

7. Payment Terms

  • Premium subscriptions are billed monthly or annually
  • Payments are processed securely through Stripe
  • Prices are in USD unless otherwise specified
  • Refunds are available within 14 days of initial purchase
  • We reserve the right to change pricing with 30 days notice
  • Failed payments may result in service suspension

8. Service Availability

  • We strive for 99.9% uptime but do not guarantee uninterrupted service
  • Scheduled maintenance will be announced in advance
  • We are not liable for service interruptions beyond our control
  • Files are automatically deleted after retention period expires

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • The Service is provided "as is" without warranties
  • We are not liable for data loss or corruption
  • We are not liable for indirect or consequential damages
  • Our total liability is limited to the amount paid for the Service
  • You use the Service at your own risk

10. Indemnification

You agree to indemnify and hold harmless Space.co.mu, its affiliates, and employees from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

11. Termination

  • You may terminate your account at any time
  • We may terminate accounts that violate these Terms
  • Upon termination, your data will be deleted within 30 days
  • Paid subscriptions will not be refunded upon termination for violations

12. Modifications to Terms

We reserve the right to modify these Terms at any time. Significant changes will be notified via email to registered users. Continued use after changes constitutes acceptance.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Republic of Mauritius, including:

  • Information and Communication Technologies Act 2001
  • Data Protection Act 2017
  • Computer Misuse and Cybercrime Act 2003
  • Electronic Transactions Act 2000
  • Copyright Act 2014

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Mauritius. The parties agree to first attempt resolution through mediation before pursuing litigation.

15. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Mauritius ICT Regulatory Compliance

Space.co.mu operates in compliance with Mauritian ICT regulations:

  • ICTA License: We maintain appropriate licenses from the Information and Communication Technologies Authority (ICTA)
  • Data Localization: User data is stored in compliance with local data residency requirements
  • Consumer Protection: We adhere to consumer protection guidelines for electronic commerce
  • Cybersecurity Standards: Implementation of security measures as per national cybersecurity guidelines
  • Content Regulation: Compliance with content regulations and takedown procedures

17. Dispute Resolution

In case of disputes:

  1. First attempt: Direct negotiation between parties
  2. Second attempt: Mediation through the Mauritius Chamber of Commerce Arbitration Center
  3. Final resort: Litigation in Mauritian courts
